Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the KomosOccasions platform (“Service”). By creating an account or using the Service you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
The Service
KomosOccasions is a multi-tenant event-planning application. Each account (“workspace”) is operated by a customer who is responsible for the data they enter and the communications they send through the Service.
Accounts and security
- You must provide accurate information and keep your credentials secure.
- You are responsible for all activity under your account and those you invite.
- You must notify us promptly of any unauthorised use.
Subscriptions, trials and billing
- The Service is offered on a subscription basis, with a free trial where indicated. Fees, billing frequency and any applicable GST are shown at sign-up and at checkout.
- Subscriptions renew automatically until cancelled. You can manage or cancel your subscription from the billing settings.
- If payment fails, access to certain features may be suspended until the account is brought up to date. Fees already paid are non-refundable except where required by law, including under the Australian Consumer Law.
Acceptable use
You agree not to:
- Use the Service unlawfully or to send spam or unsolicited communications.
- Upload malicious code or attempt to breach security or tenant isolation.
- Infringe the rights of others or misuse personal information.
- Resell or provide the Service to third parties except as permitted.
Your data
You retain ownership of the data you submit. You grant us the licence necessary to host, process and display that data to provide the Service, including transmitting relevant content to the sub-processors described in our Privacy Policy (for example, to generate AI-assisted drafts or send email). You are responsible for having the necessary rights and consents for the personal information you enter about your own clients.
AI-assisted features
Some features use automated systems to generate suggestions, drafts and summaries. These outputs may be inaccurate or incomplete. You are responsible for reviewing any AI-generated content before relying on or sending it.
Availability
We aim to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, update features, or suspend access where necessary to protect the Service or comply with the law.
Liability
Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be lawfully excluded. Subject to those rights, to the extent permitted by law our liability is limited, and we are not liable for indirect or consequential loss. The Service is provided “as is” except as required by law.
Termination
You may stop using the Service and close your workspace at any time. We may suspend or terminate access for breach of these Terms. On termination, your data is handled as described in our Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes, and continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of Australia. Disputes are subject to the jurisdiction of the Australian courts.
